1. Governing Law
Ownership transfer of motor vehicles in India is governed by the Motor Vehicles Act, 1988, and the Central Motor Vehicles Rules, 1989. The key forms involved are Form 29 (Notice of Transfer) and Form 30 (Application for Transfer of Ownership), to be submitted at the RTO where the vehicle is registered.
2. Who Handles the Transfer
Currently, RTO transfer is a seller and dealer co-responsibility facilitated by Zoop's Sales Consultants. Zoop does not act as a power of attorney holder or legal agent for either party. We provide guidance, document checklists, and coordination support.
We are actively working toward a managed transfer service where Zoop coordinates the full RTO process on the seller's behalf. This policy will be updated when that service launches.
3. Documents Required from Seller
- Original Registration Certificate (RC Book)
- Form 29 — Notice of Transfer of Ownership (signed by seller)
- Form 30 — Application for Transfer of Ownership (signed by seller)
- Valid government-issued ID proof (Aadhaar, Passport, or Voter ID)
- Address proof
- PAN card
- Valid insurance certificate
- PUC (Pollution Under Control) certificate in validity
- NOC from financer if vehicle has an active loan (hypothecation)
- NOC from state police if the vehicle is being transferred to a different state
4. Seller Obligations
- Submit signed Form 29 and Form 30 to the RTO within 14 days of vehicle handover, as required by the Motor Vehicles Act.
- Provide all original documents listed above at or before the time of vehicle pickup.
- Ensure there is no outstanding challans (traffic fines) on the vehicle at the time of transfer, as these are the seller's liability until transfer is complete.
- Obtain NOC from any financer before the sale if the vehicle has an outstanding loan.
- Notify your insurance company of the sale and cancel or transfer the existing policy.
4.1 Important: Liability Until Transfer
Until ownership is formally transferred at the RTO, you as the registered owner remain legally responsible for the vehicle under Indian law. Zoop strongly recommends completing Form 29 and Form 30 submission at the RTO promptly after vehicle handover to limit your ongoing liability.
5. Zoop's Operational Role
- Provide a document checklist to the seller in advance of pickup
- Coordinate with the buying dealer to collect required signatures on transfer forms
- Provide guidance on the RTO submission process and nearest RTO location
- Follow up with both parties to confirm transfer completion
6. Transfer Timelines
RTO processing timelines vary by state and specific RTO office. Typical timelines range from 7 to 30 working days after document submission. Delays may occur due to RTO backlog, incomplete documents, or outstanding dues on the vehicle. Zoop is not responsible for delays caused by government processing times.
7. Out-of-State Transfers
If the buying dealer is in a different state from the vehicle's registered state, additional steps are required including an NOC from the home state RTO and re-registration in the destination state. Zoop will inform both parties of these requirements upfront. Additional fees charged by the RTO for inter-state transfer are borne by the buying dealer unless otherwise agreed.
